This SMS Privacy Policy (“Policy”) outlines how we manage the Personal Information we collect when you use our SMS Service (“Service”), provided through a third-party service provider.

The Company reserves the right to amend this Policy at any time, with or without prior notice. Updates will be indicated at the top of this Policy. Changes take effect immediately upon posting, and your continued use of the Service signifies your acceptance of these changes.

“Personal Information” refers to data that identifies you personally, such as your mobile phone number or username, including any Personal Information you choose to include in messages sent through the Service.

SMS Terms of Service

Your engagement with Muller Realty’s text messaging services (“the Service”) adheres to the outlined Terms of Service, forming a binding legal agreement (“the Agreement”).

  1. By submitting your phone number, you consent to receive SMS messages from us.
  2. We retain the right to send you essential communications related to the Service, such as announcements and administrative updates, with no opt-out available. These communications will cease once our SMS service provision concludes.

  4. Please be aware that messages received on your mobile phone can be viewed by anyone with access to your device. The Company disclaims liability for any such occurrences.
  5. Consent to this service is not a prerequisite for receiving other services from the Company.
  6. By accepting these Terms of Service and submitting your mobile phone number for our Service, you authorize Muller Realty to contact you via text using automated dialing technology or other computer-assisted technology.

Enhanced Business SMS Guidelines

To comply with industry standards and guidelines, the following policies apply to our SMS solutions:

  • Send no more than 50 messages per originating number per minute. For higher volumes, consider our high-volume SMS solution.
  • Capture written consent of recipients prior to sending marketing, promotional, or informational messages.
  • Do not use purchased lists or third-party-generated lead lists.
  • Provide clear opt-out instructions on all messages.
  • Avoid using link shorteners and non-branded domains for embedded links.
  • Complete the required TCR registration before sending SMS messages.

Automated Messaging

Automated SMS messaging must only be sent from numbers linked to a TCR campaign designed for automated messaging. Prior to sending any automated messages, you must have express and logged consent from the recipient. Promotional messages must have express, written, and logged consent. Include opt-out language in each message (e.g., “Reply STOP to end”).

Opt-In/User Consent

You must have express consent to send SMS messages. Implied consent is not sufficient. Consent must be obtained for each campaign or message type. Use a double opt-in process, confirming consent via SMS and validating the number. Log and track all opt-ins and opt-outs.

Opt-Out

Provide a clear way for users to opt out of SMS messages via text. Include opt-out instructions on all informational and promotional messages. Manage and track opt-out requests to avoid sending SMS to consumers who have opted out.

Prohibited Campaigns and Content

Certain types of messages and campaigns are prohibited:

  • Loan and mortgage advertisements
  • Credit repair offers
  • Debt relief and collection attempts
  • Work-from-home advertisements
  • Political messages
  • Alcohol, tobacco, or firearms advertisements
  • Pharmaceutical, vitamin, or drug advertisements
  • Any messages that contain illegal content, hate speech, or otherwise violate our terms of service.
